Psilocybin is illegal in Oklahoma.1

  • Corrected and re-checked against the 2 sources cited below.

1. What the law is

The 2026 session produced a psychedelics law that never mentions psilocybin. The Oklahoma Breakthrough Therapy Act, HB 3834, signed May 12, 2026 and effective November 1, 2026, builds a clinical-trial framework for ibogaine alone. No psilocybin bill advanced in that session, and psilocybin is illegal in the state.

Psilocybin is illegal in Oklahoma. It is classified as a Schedule I controlled substance under the Oklahoma Uniform Controlled Dangerous Substances Act (63 O.S. § 2-204), which carries criminal penalties for possession, manufacture, and distribution. No Oklahoma statute authorizes the personal, therapeutic, or commercial use of psilocybin.

Psilocybin remains a Schedule I controlled substance in Oklahoma with no current legal pathway to access. A 2024 measure, HB 3414, would have decriminalized low-level psilocybin possession and funded research; it passed the Oklahoma House of Representatives but died without becoming law, and no successor advanced in the 2026 session. The state's only psychedelic legislation enacted to date, the Oklahoma Breakthrough Therapy Act (HB 3834), was signed by Governor Kevin Stitt on May 12, 2026, and takes effect November 1, 2026, but it establishes a clinical-trial framework for ibogaine only and does not change the legal status of psilocybin. A related measure, HB 4293, would direct ibogaine research at state universities. None of these laws creates legal access to psilocybin, which continues to be prohibited under state law.

3. History

The legal events behind this entry, dated and oldest first. Our own reviews and corrections are listed under Changes to this record.

  1. HB 3414, which would have decriminalized low-level psilocybin possession and funded research, passed the Oklahoma House of Representatives but failed to become law.

  2. Governor Kevin Stitt signed HB 3834, the Oklahoma Breakthrough Therapy Act, creating a clinical-trial framework for ibogaine only; it does not affect psilocybin's status.

HB 3834 takes effect (ibogaine research framework only).

4. Proposed laws

No psilocybin bill is pending. The two psychedelic measures of the 2026 session are ibogaine bills and neither is now pending: HB 3834, the Oklahoma Breakthrough Therapy Act, was approved by the Governor on 12 May 2026 and takes effect 1 Nov 2026, and HB 4293, the ibogaine Veterans Mental Health Innovation Act, was referred to Rules on 10 Feb 2026 and had no further action. Both statuses were checked 16 Aug 2026 on the Legislature's own bill-information pages. We have not reviewed every bill filed in the session.

Changes to this record

2 changes on file, the latest on . Show all

Every change we have made to this record, dated, corrections included. Nothing changes silently.

  1. Correction

Oklahoma moves from mixed to illegal. The only psychedelics law enacted in 2026 covers ibogaine, and no psilocybin bill was enacted.

  2. Correction

Oklahoma's entry now records the ibogaine Breakthrough Therapy Act as enacted rather than pending, and cites the enrolled text of the act. Psilocybin's status is unchanged.
