1. What the law is

Key legislation

Ala. Code § 20-2-23(b)(3) (Schedule I: Psilocybin, Psilocyn); Ala. Admin. Code 420-7-2 App. A (official Controlled Substances List)1

Alabama lists psilocybin and psilocyn in Schedule I at Ala. Code 20-2-23(b)(3). The state has enacted no change to that as of 2026.

Both psilocybin and psilocyn are named in Alabama's Schedule I, at Alabama Code Section 20-2-23(b)(3)(o)-(p). That is the most restrictive tier the Alabama Uniform Controlled Substances Act provides, and possession, manufacture, sale and distribution are criminal offenses under it. Alabama law carves out no medical, therapeutic or decriminalized use, and the legislature had enacted no such measure as of 2026.

Psilocybin's Schedule I status in Alabama derives from the Alabama Uniform Controlled Substances Act (Title 20, Chapter 2 of the Code of Alabama), which mirrors the federal Controlled Substances Act in placing psilocybin and psilocyn among substances the legislature has classified as having high abuse potential and no accepted state-recognized use. As of 2026, the Alabama Legislature has enacted no bill to decriminalize, reschedule, or create a regulated-access program for psilocybin, and no psilocybin study task force, pilot program, or therapeutic-access framework exists under Alabama law. No trigger law or contingent statute is in effect, so the substance remains fully prohibited; any future change would require new legislation passed by the Alabama Legislature. Searches of the 2024, 2025, and 2026 regular sessions identify no psilocybin reform measure advancing through the legislature.

2. Pending legislation

No bill is on file in Alabama that would change this record, as of the 18 Aug 2026 review.

5. Common questions

Is psilocybin legal in Alabama?

No. Psilocybin is illegal in Alabama. It and its metabolite psilocyn are listed as Schedule I controlled substances under Alabama Code Section 20-2-23, and no state law authorizes medical, therapeutic, or recreational use.

What is the penalty for psilocybin possession in Alabama?

Because psilocybin is a Schedule I controlled substance, possession is prosecuted as unlawful possession of a controlled substance under the Alabama Uniform Controlled Substances Act (Title 20, Chapter 2, Code of Alabama). Manufacture, sale, and distribution are separately charged offenses. Specific charges and sentencing depend on the conduct and quantity; consult the controlling statutes or a licensed attorney for case-specific exposure.

Has Alabama decriminalized psilocybin?

No. Alabama has not decriminalized psilocybin. As of 2026, the Alabama Legislature has enacted no measure to decriminalize, reschedule, or deprioritize enforcement of psilocybin offenses, and the substance remains a Schedule I controlled substance under Alabama Code Section 20-2-23.

Does Alabama have a psilocybin therapy or medical-access program?

No. No Alabama statute authorizes supervised, medical, or therapeutic psilocybin use, and no study task force or pilot program has been established under state law. Any such program would require new legislation enacted by the Alabama Legislature.

Are magic mushrooms ("shrooms") legal in Alabama?

"Magic mushrooms" and "shrooms" are common names for fungi that contain psilocybin. Psilocybin is illegal in Alabama as of 18 Aug 2026. Some laws control the compound and the fungus separately, so this record states the position for psilocybin in Alabama.
