1. What the law is
Narcotics Code B.E. 2564 (2021): psilocybin mushrooms (Psilocybe genus) are Category 5 narcotics; production, possession, sale and consumption prohibited. Ministerial Notification (2024, effective 23 Apr 2024) permits Category 5 substances including psilocybin mushrooms in FDA-approved medical treatment or research only.1
The mushroom and the molecule are scheduled separately in Thailand. Mushrooms of the Psilocybe genus are Category 5 narcotics under the Narcotics Code B.E. 2564 (2021); psilocybin itself is a Category 1 psychotropic substance. The Thai FDA publishes the penalties. Consumption carries up to 1 year imprisonment or a fine of up to 20,000 baht or both; producing, importing, exporting, selling or possessing them without permission carries up to 5 years imprisonment and a fine of up to 500,000 baht; and where the offense involves commercial intent or distribution to the public, the penalty is 1 to 15 years imprisonment and a fine of 100,000 to 1,500,000 baht. One opening remains, under a 2024 Ministerial Notification effective April 23, 2024: FDA-approved medical treatment or licensed research.
