1. 1What the law is

South Carolina names psilocybin and psilocyn in its own Schedule I, at section 44-53-190 of the state code. Nothing has been enacted to change that as of 2026, and we have found no psilocybin bill in the legislature.

Psilocybin is illegal in South Carolina. The state classifies both psilocybin and psilocyn as Schedule I controlled substances under South Carolina Code Section 44-53-190(D), which lists hallucinogenic substances the state deems to have a high potential for abuse and no accepted medical use. Manufacture, distribution, and possession are prohibited and prosecuted under the penalty provisions of Section 44-53-370. As of 2026, no enacted state law authorizes any legal psilocybin program in South Carolina.

South Carolina regulates psilocybin through its Controlled Substances Act, codified at Title 44, Chapter 53 of the South Carolina Code of Laws. Section 44-53-190 enumerates Schedule I substances and expressly lists psilocybin and psilocyn among the controlled hallucinogens. The General Assembly has not enacted any decriminalization measure, therapeutic-use framework, or study task force for psilocybin, and no reform bill has passed either chamber. Because no such measure exists, there is no current legal access to psilocybin in South Carolina; the substance remains illegal under state law, and possession, manufacture, and distribution remain offenses under Section 44-53-370.
