1. What the law is
The 2026 session produced a psychedelics law that never mentions psilocybin. The Oklahoma Breakthrough Therapy Act, HB 3834, signed May 12, 2026 and effective November 1, 2026, builds a clinical-trial framework for ibogaine alone. No psilocybin bill advanced in that session, and psilocybin is illegal in the state.

The two psychedelic measures of the 2026 session are ibogaine bills and neither is now pending: HB 3834, the Oklahoma Breakthrough Therapy Act, was approved by the Governor on 12 May 2026 and takes effect 1 Nov 2026, and HB 4293, the ibogaine Veterans Mental Health Innovation Act, was referred to Rules on 10 Feb 2026 and had no further action.
