1. What the law is
Criminal Code article 259 (consolidated redaction in force 3 July 2026; the article was last amended on 7 November 2024 by law XIV-3060): unlawful production, processing, acquisition, keeping, transport or sending of narcotic or psychotropic substances without intent to sell or otherwise distribute is punishable by community service, a fine, restriction of liberty, arrest, or imprisonment of up to 2 years (art. 259(1)); where the quantity is small the act is a criminal misdemeanour punishable by community service, a fine, restriction of liberty or arrest, with no imprisonment (art. 259(2)). Using narcotic, psychotropic or other psychoactive substances without a doctor's prescription is a separate administrative offense under article 71 of the Code of Administrative Offences, carrying a fine of EUR 30 to 150, rising to EUR 150 to 230 on repetition. Psilocybin and psilocin are List I substances under the Health Minister's order No. 5 of 6 January 2000, which also lists the fruiting bodies, the spores and the mycelium of fungi of the genus Psilocybe.1
Lithuania tightened rather than loosened. Administrative, non-criminal liability for small-quantity possession was abolished in 2017, so holding even a small amount of psilocybin for personal use is a criminal offense under Article 259(2) of the Criminal Code, punishable by community service, restriction of liberty, a fine or short-term arrest. Decriminalization attempts in 2021 and 2022 failed or stalled in parliament.

A cannabis-only amendment adding small-quantity cannabis possession to the Code of Administrative Offences passed a vote on 15 December 2022 but was referred back to committee without removal from the Criminal Code; broader decriminalization was rejected by the Seimas in November 2021. The Seimas bill register could not be read when this entry was last checked on 16 August 2026, so nothing here is claimed about bills now before parliament.
