1. What the law is
DPR 309/1990 (Testo Unico in materia di disciplina degli stupefacenti e sostanze psicotrope), article 75: importing, exporting, purchasing, receiving on any basis and holding for personal use are non-criminal administrative offenses, sanctioned by suspension of a driving license, a firearms license, a passport or any equivalent document, and a residence permit issued for tourism in the case of non-EU nationals, for two to twelve months where the substance is in Tabella I, with a separate ban of up to three years on obtaining a driving license. Article 73 keeps supply and trafficking criminal. Scheduling: Tabella I, annexed to the same decree, lists psilocibina, psilocina and funghi del genere strofaria, conocybe e psilocybe. DM Salute 11 aprile 2006 sets a maximum daily quantity for the two compounds and none for the fungi entry, and under article 75 comma 1-bis exceeding it is one circumstance among several rather than an automatic offense.1
In Italy the penalty for personal possession is paperwork.
