1. What the law is
In Italy the penalty for personal possession is paperwork. Article 75 makes importing, exporting, buying, receiving on any basis and simply holding an administrative offense, and what it suspends is documents: a driving license, a firearms license, a passport or an equivalent document, and, for a non-EU national, a residence permit issued for tourism. Psilocybin, psilocin and mushrooms of the Stropharia, Conocybe and Psilocybe genera sit in Tabella I, which carries the longer band of two to twelve months. Supplying and trafficking stay criminal under article 73, and whether an amount was held for personal use is judged from its quantity, its packaging and the other circumstances together.

DPR 309/1990 (Testo Unico in materia di disciplina degli stupefacenti e sostanze psicotrope), article 75: importing, exporting, purchasing, receiving on any basis and holding for personal use are non-criminal administrative offenses, sanctioned by suspending one or more of a driving license, a firearms license, a passport or any equivalent document and, for non-EU nationals, a residence permit issued for tourism, for two to twelve months where the substance is in Tabella I, with a separate ban of up to three years on obtaining a driving license. Article 73 keeps supply and trafficking criminal. Scheduling: Tabella I, annexed to the same decree, lists psilocibina, psilocina and funghi del genere strofaria, conocybe e psilocybe. DM Salute 11 aprile 2006, returned to effect by article 2 of decree-law 36/2014, sets a threshold of 300 mg each for psilocybin and psilocin, an average single dose of 100 mg multiplied by three, and measures the fungi entry by the psilocybin and psilocin it contains. Under article 75 comma 1-bis, staying within it is weighed alongside packaging, gross weight and the other circumstances of the act in deciding whether possession was for personal use.1

Italy's entry was corrected. It had described the 2006 health ministry decree as setting a daily limit for psilocybin and psilocin and none for the mushrooms. The decree sets a threshold of 300 mg each, worked out from an average single dose, and measures mushrooms by the psilocybin and psilocin they contain; the entry now also cites the 2014 decree-law that put that decree back into effect after the Constitutional Court's judgment that year. The legal status is unchanged.
Italy's entry now cites the consolidated Testo Unico directly. The summary lists what article 75 actually reaches and what it suspends, and treats quantity as a circumstance courts weigh rather than a line that decides the case.
Italy's decriminalized status was confirmed: personal possession is an administrative offense under article 75 of DPR 309/1990, not a crime.
