1. What the law is

Key legislation

Law 30/2000 (Lei n. 30/2000, Diario da Republica I Serie-A no. 276 of 29 November 2000): consumption, acquisition and possession for personal use of any plant, substance or preparation in Tables I to IV annexed to Decree-Law 15/93 is an administrative offense (contra-ordenacao) rather than a crime (art. 2(1)), limited to the quantity needed for average individual consumption over a 10-day period (art. 2(2)). Article 15 allows a fine or an alternative non-pecuniary sanction for non-dependent consumers, and only non-pecuniary sanctions for dependent consumers. Article 28 repealed article 40 of Decree-Law 15/93 except as to cultivation, and article 41, so cultivation and supply remain criminal. Article 29 brought the decriminalization into force on 1 July 2001. Psilocybin is not named in Law 30/2000; it falls within the regime only because it remains a controlled substance in the Decree-Law 15/93 tables.1

Law 30/2000 never mentions psilocybin. Portugal decriminalized personal use of every drug at once, effective 1 July 2001, and psilocybin falls inside that regime only because it is listed in the Decree-Law 15/93 tables the law points to. Possession of up to a 10-day supply is an administrative offense, handled by Dissuasion Commissions instead of criminal courts. Cultivation and supply are still crimes, and no psilocybin-specific reform has followed.
