1. What the law is
Criminal Code amendments in force 1 January 2013: possession of small quantities for personal use reclassified from criminal offense to non-criminal misdemeanour (fine EUR 650-2,600 or up to 90 days misdemeanour detention).1
Croatian law does not fix what counts as a small quantity. Prosecutors and courts decide that case by case, and their answer separates a fine from a prosecution. Criminal Code amendments in force since 1 January 2013 made personal possession, psilocybin mushrooms included, a non-criminal misdemeanor punishable by a fine of EUR 650 to 2,600. Production, sale and trafficking stayed criminal, at 1 to 12 years.
