1. What the law is

Key legislation

Code of Administrative Offenses article 44: production, acquisition, storage, transport or forwarding of small amounts without intent to sell is an administrative offense (fine of 50 to 100 non-taxable minimum incomes, community works of 20 to 60 hours, or administrative arrest up to 15 days; voluntary surrender releases from liability). Criminal Code article 309 (above small amounts, no intent to sell): part 1 carries a fine of 1,000 to 3,000 non-taxable minimum incomes, corrective labour up to 2 years, probation supervision up to 5 years or restriction of liberty for the same term, with no imprisonment since Law No. 3342-IX of August 23, 2023; part 2 (a group, a repeat within a year of conviction, or large amounts) carries up to 3 years imprisonment. Small-amount thresholds per Ministry of Health Order No. 188 (2000), Table 2: psilocybin or psilocin 0.01 grams; psilocybin- or psilocin-containing mushroom fruiting bodies 0.5 grams. Psilocybin, psilocin and the fruiting bodies are prohibited especially dangerous psychotropic substances under Cabinet of Ministers Resolution No. 770 (2000), Table I, List No. 2.1

Where the line falls in Ukraine is a question of quantity. Small amounts held without intent to sell are an administrative matter under the Code of Administrative Offenses, answered with a fine, community service or administrative arrest of up to 15 days. Drug use anywhere other than in public is not a criminal offense. Above the small-amount thresholds set by Health Ministry Order No. 188, possession becomes criminal under article 309 of the Criminal Code.

2. Pending legislation

The Ministry of Health published draft documents for public consultation in March 2025 to move psilocybin, psilocin, LSD, DMT, 5-MeO-DMT, MDMA and ibogaine out of the most restrictive category so that scientific research is permitted, alongside a research-licensing by-law. Nothing has been adopted. As of July 31, 2026, psilocybin, psilocin and psilocybin-containing fungal fruiting bodies remain in Table I, List No. 2 of Cabinet of Ministers Resolution No. 770, in the consolidated text current to June 7, 2026.
