1. What the law is
Narcotic Drugs and Psychotropic Substances Act (NPALS) section 15-1: consumption of a narcotic or psychotropic substance without a prescription, or unlawful manufacture, acquisition or possession of a small quantity, is a misdemeanour punishable by a fine of up to 300 fine units or by detention (ceiling in force since January 1, 2015); section 15-3 assigns these cases to the Police and Border Guard Board and the Tax and Customs Board as extra-judicial bodies. Penal Code section 183 (as narrowed with effect from July 1, 2019): small-quantity handling is criminal only where done for the purpose of transfer; section 184: unlawful handling of large quantities carries 1 to 10 years imprisonment.1
Small-quantity cases in Estonia never reach a court. Consumption without a prescription, and possession of a small quantity for personal use, are misdemeanors under section 15-1 of the Narcotic Drugs and Psychotropic Substances Act, punishable by a fine of up to 300 fine units or by detention. Handling a small quantity becomes a criminal matter only when it is done for the purpose of transfer, under Penal Code section 183; large quantities carry 1 to 10 years under section 184. Psilocybin, psilocin and the mushrooms containing them are named in Schedule I.

A Ministry of Justice draft amendment to the Penal Code, under consultation and reported by ERR, would separate dependent users from dealers more sharply: lighter treatment for users, tougher rules for dealers. The minister has said possession of any narcotic would stay a misdemeanor, with a fine of up to about EUR 2,400, and that this is not decriminalization beyond what the law already allows.
