1. What the law is

Key legislation

SB 2308 (89R, 2025) - ibogaine clinical-trial consortium with $50M state funding, signed and effective June 11, 2025. HB 1802 (2021) psilocybin study expired Sept 2025. Psilocybin remains a Penalty Group 2 controlled substance under Texas law.1

Texas put $50 million into psychedelic research and none of it into access. SB 2308 (2025) created an ibogaine clinical-trial program; when no drug company came forward to partner on it, the state announced in March 2026 that it would run the trials itself through UTHealth Houston and UT Medical Branch Galveston. That money buys trials, not treatment. Possession is still a criminal offense, and no bill legalizes or decriminalizes psilocybin.

Texas maintains full prohibition of psilocybin as a Schedule I controlled substance under the Texas Controlled Substances Act. Possession is a felony. However, the Texas legislature has shown unexpected interest in psilocybin research. In 2021, HB 1802 passed with bipartisan support, directing the state to study the therapeutic potential of psilocybin for veterans with PTSD and treatment-resistant depression. The study, conducted through Baylor College of Medicine and other institutions, is ongoing. Additional bills expanding research access and proposing limited medical exemptions have been introduced in subsequent legislative sessions but have not passed. Texas represents a jurisdiction where the medical research pathway may precede any decriminalization or access legislation.

The veterans' mental health angle has given psilocybin research bipartisan traction in Texas that is rare for drug policy reform in conservative states. HB 1802 passed with support from both Republican and Democratic legislators. This research-first approach could create a pathway to medical access without broader decriminalization, a model other conservative states may follow.
