1. What the law is
Ley General de Salud Art. 245-I lists psilocybin, psilocin and 'hongos alucinantes de cualquier variedad botanica' as prohibited substances with no recognized therapeutic value; Art. 479 personal-dose table (opium, heroin, cannabis, cocaine, LSD, MDA, MDMA, methamphetamine) does NOT include psilocybin, so the Art. 478 non-prosecution rule for personal use does not apply. Codigo Penal Federal Art. 195 bis: simple possession = 4 to 7.5 years prison, with non-prosecution only for peyote/hallucinogenic mushrooms presumed destined for ceremonies of indigenous and Afro-Mexican communities (fraction II, reformed DOF 01 Apr 2024).1
Mexico stopped prosecuting small quantities of certain drugs in 2009, and psilocybin was never one of them. The Article 479 personal-dose table leaves it out, while Article 245 fraction I of the Ley General de Salud prohibits psilocybin, psilocin and hallucinogenic mushrooms of any botanical variety. Simple possession carries 4 to 7.5 years imprisonment under Article 195 bis of the Federal Penal Code. One carve-out survives: no prosecution where quantity and circumstances indicate use in ceremonies of indigenous or Afro-Mexican communities.
2. Pending legislation
Senator Alejandra Lagunes presented an initiative in October 2023 to reform provisions on traditional medicine and its bioconservation, the therapeutic use of entheogens, and the promotion of research into medical uses of psychotropics; it was referred to the Comisiones Unidas de Salud y de Estudios Legislativos. Whether it survived into the current legislature was not established on review of 16 Aug 2026 and is not asserted either way. No reform has been enacted: the Ley General de Salud in force is consolidated to DOF 15-01-2026 and the Codigo Penal Federal to DOF 13-03-2026, and neither changes the position of psilocybin.
