1. What the law is

Key legislation

Law on the Legal Circulation of Narcotic and Psychotropic Substances, Medicinal Products and Precursors, section 48(1) (chapter IX, in force since July 1, 2020): unauthorised acquisition or storage of a small amount, or unauthorised use, draws a warning or a fine of 10 to 56 fine units, which is EUR 50 to 280 at EUR 5 per unit under section 16 of the Administrative Liability Law; section 48(3): the offender is simultaneously warned in writing of criminal liability for a repeat within one year. Criminal Law section 253.2: small-amount acquisition, storage or use by a person so warned is a criminal offense (short-term imprisonment, probation supervision, community service or a fine); section 253(1): above the small amount without intent to sell, up to 3 years imprisonment; section 253(2): large amounts or a group, 3 to 10 years. Small-amount ceiling for hallucinogenic mushrooms: 0.5 grams dried, 5 grams undried (Appendix 2 to the Law on the Procedures for the Coming into Force and Application of the Criminal Law).1

A first offense in Latvia comes with a written warning, and that warning is what makes the second one criminal. Acquiring or storing a small amount, or using, draws a warning or a fine of EUR 50 to 280 as an administrative matter; a repeat within a year of that warning is a criminal offense. For hallucinogenic mushrooms the small-amount ceiling is 0.5 grams dried, and possession above it carries up to 3 years in prison.
