1. What the law is

Key legislation

Ley 20.000 (2005), arts. 4 and 50: possession for exclusive personal use proximate in time is excluded from the criminal possession/trafficking offense; consumption or carrying for personal use in public places is a falta (infraction) punished with fines, prevention programs, or community service, not prison. Amended by Ley 21.817 (Diario Oficial 23 May 2026), which added a final paragraph to art. 4 applying the art. 1 penalty to small quantities of substances the reglamento classifies as capable of grave toxic effects; decreto 867 of 2007 art. 1 lists Psilocibina and Psilocina, and the transitional article of Ley 21.817 requires the Ministry of Public Security to incorporate a new classification into that decree within six months of publication.1

Possessing a small amount of psilocybin for personal use is not a crime in Chile. Supplying it is. Ley 20.000 excludes possession that is proximate in time and for exclusive personal use from the trafficking offense. Consuming or carrying it in a public place is an infraction, punished by a fine, a prevention program or community service rather than prison. That position may narrow. Ley 21.817, published on 23 May 2026, added a paragraph applying the trafficking penalty to small quantities of substances the implementing regulation classifies as capable of grave toxic effects. Decreto 867 already lists psilocybin and psilocin among them. The same act gives the Ministry of Public Security six months to write the classification that paragraph depends on, and that step has not been verified as taken, so the effect on psilocybin is not yet established.

2. Pending legislation

Introduced but not yet law. If a bill passes, this record changes with it.

Implementing regulation pending. Ley 21.817 requires the Ministry of Public Security to amend decreto 867 of 2007 to add a new classification of substances capable of grave toxic effects, within six months of 23 May 2026. Until that amendment is made, the new final paragraph of article 4 has no classification to apply.
