Key legislation

Constitutional Court Sentencia C-221 de 1994 (5 May 1994): the criminal penalties in Ley 30 de 1986 arts. 51 and 87 for possessing the personal dose held unconstitutional. Sentencia C-491 de 2012 preserved Penal Code art. 376 and read a personal-dose carve-out into it, expressly leaving those quantities punishable when held for distribution. Decreto 2114 de 2023 (7 Dec 2023) art. 1 repealed Decreto 1844 de 2018 and its police fines for personal-dose possession. Scheduling: Ministerio de Salud Resolucion 116 de 2026, Anexo Tecnico 1, entries 407 and 408 (Lista Verde, Lista I).1

A judgment, not a statute, is what protects a psilocybin user in Colombia. The personal-dose table in Ley 30 de 1986 names cannabis, hashish, cocaine and methaqualone, and no quantity in it covers psilocybin; the cover comes from the general wording of the Constitutional Court ruling that struck the criminal penalty in 1994, holding that punishment violated the free development of personality. A 2009 amendment wrote a prohibition into the constitutional text without attaching a penalty, and the Court has refused to supply one. Decreto 2114 ended the police fines in December 2023.
